1. Agreement to Terms

By accessing, browsing, or using the website located at soulmystica.xyz (the "Site"), operated by Mia from Soulmystica ("we," "us," "our," or "Soulmystica"), you ("you," "your," or "User") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Disclaimer, all of which are incorporated herein by reference.

If you do not agree to these Terms, you must immediately discontinue use of the Site and all services offered herein. Your continued use of the Site following the posting of any changes to these Terms constitutes your acceptance of such changes.

By submitting your email address on this Site, you explicitly acknowledge and agree to these Terms of Service, our Privacy Policy, and our Disclaimer. This constitutes your electronic signature and binding acceptance of all terms contained herein.

2. Nature of Services - Entertainment Purpose Only

THE SERVICES PROVIDED ON THIS SITE, INCLUDING BUT NOT LIMITED TO SOULMATE SKETCHES, PSYCHIC READINGS, COMPATIBILITY ANALYSES, PERSONALITY READINGS, ENERGY READINGS, AND ALL RELATED CONTENT (COLLECTIVELY, THE "SERVICES"), ARE PROVIDED STRICTLY FOR ENTERTAINMENT AND AMUSEMENT PURPOSES ONLY.

You expressly acknowledge and agree that:

  • The Services are a form of entertainment and should be treated as such. They are not professional advice of any kind, including but not limited to psychological, medical, legal, financial, or relationship advice.
  • The sketches, portraits, readings, and all other deliverables are artistic and creative works produced for entertainment value. They are not scientifically verified, empirically tested, or based on any proven methodology.
  • No psychic, spiritual, metaphysical, or supernatural claim made on the Site or in connection with the Services has been evaluated, tested, or verified by any scientific, medical, or governmental authority.
  • The Services do not predict actual future events, identify real individuals, or guarantee any specific outcome in your personal, romantic, or professional life.
  • Any resemblance between a soulmate sketch and any real person, living or dead, is entirely coincidental.
  • Testimonials, reviews, and user stories displayed on the Site are individual experiences and are not representative of guaranteed outcomes. Individual results will vary significantly and most users should not expect similar results.

3. No Guarantees of Results or Outcomes

SOULMYSTICA MAKES NO GUARANTEES, WARRANTIES, REPRESENTATIONS, OR PROMISES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, USEFULNESS, OR QUALITY OF ANY SERVICES, SKETCHES, READINGS, OR OTHER DELIVERABLES PROVIDED.

Specifically, we do not guarantee that:

  • You will meet, encounter, or recognize any individual resembling a soulmate sketch.
  • Any reading, prediction, or insight provided will come true, be accurate, or be relevant to your life circumstances.
  • The Services will result in any specific emotional, psychological, romantic, or spiritual outcome.
  • The sketches will depict a real person, your actual future partner, or anyone you will ever meet.
  • The information provided in any reading is factually correct or verifiable.

You acknowledge that any decisions you make based on the Services are made entirely at your own risk and discretion. We shall not be held liable for any consequences, whether direct, indirect, incidental, or consequential, arising from your reliance on or use of the Services.

4. Payment Terms and Pricing

All prices displayed on the Site are in United States Dollars (USD) unless otherwise specified. By completing a purchase, you agree to pay the total amount displayed at checkout, including any applicable taxes or fees.

Payment is processed securely through Stripe, a PCI-DSS Level 1 certified payment processor. Soulmystica does not store, process, or have direct access to your full credit card or debit card numbers. All payment information is handled directly by Stripe in accordance with their own terms of service and privacy policy.

All purchases are final upon completion of the transaction. By completing a purchase, you acknowledge that you are purchasing a digital entertainment product and that the creative work begins immediately upon receipt of payment.

5. Refund Policy and Chargeback Prevention

All sales are considered final. Because the Services involve the creation and delivery of personalized digital content that is produced specifically for you based on the information you provide, refunds are generally not available once the digital product has been delivered or made available for download/viewing.

Limited Satisfaction Guarantee: If you are genuinely dissatisfied with your soulmate sketch, you may contact us at hello@soulmystica.xyz within seven (7) calendar days of your purchase date to request a review. We may, at our sole and absolute discretion, offer a one-time courtesy credit, a replacement sketch, or, in rare circumstances, a partial or full refund. This guarantee is limited to one (1) claim per customer and is subject to our sole discretion.

Chargebacks and Payment Disputes: By making a purchase on this Site, you agree to contact us directly at hello@soulmystica.xyz before initiating any chargeback, payment dispute, or claim with your bank, credit card company, or payment provider. We commit to resolving any legitimate concern promptly and in good faith.

You acknowledge and agree that:

  • You have read and understood the nature of the Services (entertainment purposes only) prior to making your purchase.
  • Initiating a chargeback or payment dispute without first contacting us constitutes a breach of these Terms.
  • A chargeback filed after the digital product has been delivered and viewed constitutes potential fraud and may be contested with full documentation, including proof of delivery, your IP address, device information, and interaction logs.
  • We reserve the right to submit evidence of the transaction, including these Terms you agreed to, your order details, delivery confirmation, and your usage of the delivered product, to your payment provider in the event of a chargeback dispute.
  • Fraudulent chargebacks may result in permanent banning from the Site, collection actions, and reporting to fraud prevention databases.
  • The filing of a fraudulent chargeback may result in legal action to recover the amount of the chargeback plus administrative fees, legal fees, and any chargeback penalties assessed by the payment processor.

Non-Refundable Circumstances: Refunds will NOT be issued for: (a) change of mind after purchase; (b) dissatisfaction with the artistic style or appearance of a sketch; (c) failure to meet a specific person resembling the sketch; (d) disagreement with the content of a reading; (e) purchases made more than seven (7) days ago; (f) situations where the digital product has already been viewed, downloaded, or accessed; or (g) any claim based on the expectation that the Services would produce scientifically verifiable or guaranteed results.

6. Digital Product Delivery

Upon successful payment, your personalized soulmate sketch and/or reading will be made available to you via the Site within the timeframe indicated at the time of purchase. Delivery is considered complete once the digital product is made accessible to you through the Site, regardless of whether you choose to view or download it.

By completing a purchase, you expressly consent to the immediate commencement of digital content creation and acknowledge that this constitutes the beginning of service performance. Under applicable consumer protection laws, including but not limited to the EU Consumer Rights Directive (where applicable), you hereby waive any right of withdrawal or cooling-off period that may otherwise apply to digital content once performance has begun with your prior express consent.

You are solely responsible for providing a valid email address and maintaining access to the link provided. We are not responsible for undelivered products resulting from incorrect email addresses, spam filters, full inboxes, or technical issues on your end.

7. Intellectual Property Rights

All content on the Site, including but not limited to text, graphics, logos, images, audio, video, sketches, software, and the compilation thereof, is the exclusive property of Soulmystica or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

Upon purchase, you are granted a limited, non-exclusive, non-transferable, personal license to view and use your soulmate sketch for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Site or your purchased products for commercial purposes without our prior written consent.

8. User Representations and Warranties

By using the Site and purchasing the Services, you represent and warrant that:

  • You are at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is greater.
  • You have the legal capacity to enter into a binding agreement.
  • All information you provide is truthful, accurate, and complete.
  • You understand that the Services are for entertainment purposes only and are not a substitute for professional advice.
  • You will not use the Services for any unlawful purpose or in violation of these Terms.
  • You are the authorized holder of the payment method used for the purchase.
  • You have read and fully understand the nature of the Services before making a purchase.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOULMYSTICA, ITS OPERATORS, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to use the Site or Services;
  • Any conduct or content of any third party on the Site;
  • Any content obtained from the Site or Services;
  • Any actions taken or decisions made based on the Services, sketches, or readings;
  • Unauthorized access, use, or alteration of your transmissions or content;
  • Emotional distress, disappointment, or dissatisfaction arising from the use of the Services.

In no event shall our total aggregate liability to you for all claims arising out of or related to the Site or Services exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

10. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information, text, graphics, links, or other content provided through the Services.

11. Indemnification

You agree to indemnify, defend, and hold harmless Soulmystica, its operators, affiliates, officers, directors, employees, consultants, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any chargeback or payment dispute you initiate.

12. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration administered by a mutually agreed-upon arbitration provider, with the arbitration conducted in English.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Electronic Communications and Consent

By providing your email address and using the Site, you consent to receive electronic communications from us, including but not limited to order confirmations, delivery notifications, product updates, and promotional messages. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

You may unsubscribe from promotional emails at any time by clicking the unsubscribe link in any email or by contacting us at hello@soulmystica.xyz. Transactional emails related to your purchase cannot be opted out of.

14. Modifications to Terms

We reserve the right to modify, amend, or update these Terms at any time and at our sole discretion. Changes will be effective immediately upon posting to the Site. The "Last Updated" date at the top of these Terms will be revised accordingly. Your continued use of the Site after any such changes constitutes your binding acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. The unenforceable provision shall be replaced with a valid, enforceable provision that most closely approximates the intent of the original provision.

16. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and Soulmystica regarding the use of the Site and Services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
